General Terms and Conditions (GTC)
1. SCOPE OF APPLICATION
The business relationship between WilldMe OG, Stadtblick 1, A-4202 Kirchschlag, hereinafter referred to as “WilldMe or WilldMe OG” or “Seller”, and the customer or buyer shall be governed exclusively by the following General Terms and Conditions in the version valid at the time of the order.
Unless expressly agreed otherwise in writing, these apply to all deliveries of goods made on the basis of orders placed by consumers (within the meaning of the Austrian Consumer Protection Act (KSchG)) via distance selling or, mutatis mutandis, to contracts concluded outside WilldMe's business premises.
Deviating conditions, amendments or additions to this contract are only effective if they have been confirmed in writing by WilldMe OG.
Attention! These terms and conditions become part of the contract in distance selling by sending your order.
2. ONLINE ORDERING
Our offers are non-binding in their entirety - deliveries are made while stocks last. In distance selling, a contract is only concluded after your order has been sent by our order confirmation or by delivery. The automatically sent order confirmation is for your information and control only and is not considered an order confirmation.
Any deviations from your order must be reported immediately after receipt of the order confirmation or otherwise at the latest after receipt of the goods by means of an objection - in writing or by e-mail to WilldMe OG, Stadtblick 1, A-4202 Kirchschlag or office@willdme.at.
WilldMe OG is entitled not to accept orders or to accept them only in part. If an order is rejected by us, WilldMe OG will notify you immediately.
3. PRICES AND SHIPPING COSTS
The prices stated on the Internet apply to online orders. By placing an order, you accept the prices and shipping costs listed there.
The product prices quoted are in euros and include 10% VAT, excluding delivery costs and ancillary services.
AT: Unless otherwise agreed, shipping costs of EUR 4.50 - which are automatically calculated and communicated during the ordering process - will be charged to the customer for orders under EUR 50.00 gross. From an order value of EUR 50.00 gross per order, delivery is free of charge.
DE: Unless otherwise agreed, the shipping costs of EUR 9.50 - which are automatically calculated and announced during the ordering process - will be charged to the customer additionally for orders with a gross value of less than EUR 80.00 per order. From an order value of EUR 80.00 gross per order, delivery is free of charge.
For deliveries outside the countries of the European Union (EU), additional fees (e.g. for export, import and customs) as well as import sales tax may apply.
Writing, printing, calculation and online store system errors as well as extraordinary price changes are reserved.
4. PAYMENT
WilldMe OG shall invoice our services upon or immediately after delivery. In the case of separately agreed partial deliveries, invoicing shall be carried out in accordance with the individual partial deliveries. Any changes to the customer's address must be communicated to WilldMe OG immediately.
We ask for your understanding that distance selling orders with a gross purchase value of more than € 200,- will only be shipped against prepayment.
In this case, you will receive the invoice by e-mail after completion of the order.
Payments from foreign banks are free of charge within the EU if you state the IBAN and SWIFT code for our bank details below on the transfer.

The invoice amount is due for payment within 10 days without deduction. In the event of late payment, statutory default interest will be charged.
Reminder, collection and out-of-court legal fees shall be borne by you.
5. RIGHT OF WITHDRAWAL
The customer may withdraw from the purchase contract within 14 days of receipt of the goods in writing, by e-mail or by returning the goods.
In the event of withdrawal, full or partial reimbursement of the purchase price shall only take place concurrently with the return of the goods received from the purchaser.
The costs and risks of the return shipment shall be borne by the buyer.
The goods must be returned to WilldMe OG in unused and resalable condition in their original packaging. If items show signs of use or if the packaging is damaged or if the goods are returned freight collect, WilldMe OG shall retain a reasonable fee for the reduction in value or the costs incurred.
6. DELIVERY AND DELIVERY TIME
We deliver as quickly as possible by parcel service, post or forwarding agent - usually within a few days. WilldMe OG reserves the right to choose the transport company.
Please note that the delivery time depends on the transport company, we have no influence on this and therefore cannot guarantee a delivery date. Please indicate any obstacles (e.g.: absence on the day of delivery, ...) when ordering.
If measures and costs are incurred for the storage of the delivered goods, these shall be borne by and at the expense of the customer and shall be deemed to be delivery.
7. TRANSPORT DAMAGE, COMPLAINTS
The goods must be inspected immediately after delivery. Any defects discovered must be reported to the seller immediately, but at the latest within 3 days of delivery, stating the nature and extent of the defect.
Hidden defects must be reported immediately after their discovery.
Obvious damage/defects must be reported to the seller immediately (incl. photo), only then can we guarantee you a free replacement.
8. COMPENSATION FOR DAMAGES AND PRODUCT LIABILITY
Claims for damages in cases of slight negligence are excluded - with the exception of personal injury. Any recourse claims directed against us under the title of product liability within the meaning of the Product Liability Act are excluded unless the party entitled to recourse proves that the defect was caused in our sphere and was at least due to gross negligence.
9. RESERVATION OF TITLE
The delivered goods shall remain the property of WilldMe OG until all claims against the customer have been paid in full.
10. Place of performance and choice of law
The place of performance is the registered office of our company in A-4202 Kirchschlag, Stadtblick1, Austria.
Austrian substantive law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods and private international law, including its conflict of law rules.
The contract language is German.
11. DATA PROTECTION
The customer declares his consent that his personal data contained in the purchase contract may be collected, stored and processed by WilldMe OG. It goes without saying that we undertake to protect your personal data in accordance with the provisions of the Data Protection Act. In addition, we assure you that your personal data will not be passed on to third parties, but will only be used by our logistics service providers and for our own marketing purposes.
